Practitioner Terms of Service

These Practitioner Terms of Service ("Practitioner Terms") govern your use of the Healing Care platform as a healthcare provider. By registering as a practitioner, you agree to these terms in addition to our general Terms of Service. PLEASE READ THESE TERMS CAREFULLY.

Important Notice for Practitioners

These terms establish your independent contractor status and your responsibilities for medical practice on our platform. Please read carefully before registering.

1. Independent Contractor Relationship

BY ACCEPTING THESE TERMS, YOU ACKNOWLEDGE AND AGREE THAT:

  • You are an INDEPENDENT CONTRACTOR, not an employee, agent, or representative of Healing Care
  • Healing Care does NOT employ, supervise, direct, or control your medical practice
  • You maintain full autonomy over your medical decisions, diagnoses, treatments, and recommendations
  • You are solely responsible for your own taxes, insurance, and business expenses
  • No employment relationship, partnership, or joint venture is created by this agreement
  • You may provide services through other platforms or maintain your own practice

This independent contractor relationship is a fundamental term of this agreement. Any attempt to characterize this relationship otherwise shall not be binding on Healing Care.

2. Professional Qualifications and Licensing

You represent, warrant, and agree to maintain throughout your use of the platform:

  • A valid, unrestricted medical license in your jurisdiction of practice
  • All required certifications and credentials for your specialty
  • Good standing with all relevant medical boards and regulatory bodies
  • No history of license revocation, suspension, or disciplinary action (unless disclosed)
  • Compliance with all continuing education requirements
  • Immediate notification to Healing Care of any changes to your licensing status

You authorize Healing Care to verify your credentials and conduct background checks. Failure to maintain valid licensing will result in immediate account suspension.

3. MALPRACTICE INSURANCE REQUIREMENT

YOU MUST MAINTAIN ADEQUATE PROFESSIONAL LIABILITY INSURANCE:

  • Maintain professional liability (malpractice) insurance with coverage appropriate for your specialty
  • Minimum recommended coverage: €500,000 per occurrence / €1,500,000 aggregate (or equivalent)
  • Provide proof of insurance upon request
  • Notify Healing Care immediately if your insurance lapses or is cancelled
  • Ensure your policy covers telemedicine/online consultations if you provide such services
  • Maintain tail coverage if you switch from claims-made to occurrence-based policies

HEALING CARE DOES NOT PROVIDE MALPRACTICE INSURANCE. You are solely responsible for obtaining and maintaining appropriate coverage. Practicing without adequate insurance may result in account termination.

4. Medical Content and Advice Responsibility

YOU ARE SOLELY AND FULLY RESPONSIBLE FOR:

  • All medical advice, diagnoses, treatment recommendations, and prescriptions you provide
  • The accuracy, completeness, and appropriateness of all medical information you share
  • All answers, posts, comments, and content you publish on the platform
  • Ensuring your advice meets applicable standards of care
  • Maintaining appropriate patient records as required by law
  • Following up on patient inquiries in a timely and professional manner
  • Clearly communicating limitations of online consultations

HEALING CARE DOES NOT REVIEW, ENDORSE, OR VERIFY YOUR MEDICAL CONTENT. You acknowledge that your medical advice may be relied upon by patients, and you accept full professional and legal responsibility for such advice.

5. Standard of Care

You agree to provide services in accordance with:

  • The applicable standard of care for your specialty and jurisdiction
  • All relevant medical ethics codes and professional guidelines
  • Applicable healthcare laws and regulations
  • Best practices for telemedicine and online healthcare delivery
  • Patient privacy and confidentiality requirements (GDPR, applicable healthcare regulations)
  • Informed consent requirements for all consultations and treatments

6. Prohibited Conduct

You agree NOT to:

  • Provide medical advice outside your area of competence or licensing
  • Guarantee specific medical outcomes or make misleading claims
  • Prescribe controlled substances inappropriately or in violation of regulations
  • Engage in any form of patient harassment, discrimination, or inappropriate conduct
  • Share patient information without proper consent or legal authorization
  • Manipulate reviews, ratings, or feedback
  • Use the platform for any unlawful purpose
  • Misrepresent your qualifications, experience, or credentials
  • Provide emergency medical care through the platform (direct patients to emergency services)

7. Patient Relationships

You acknowledge and agree that:

  • Any doctor-patient relationship is solely between you and the patient
  • Healing Care is not a party to the doctor-patient relationship
  • You are responsible for obtaining informed consent from patients
  • You must maintain appropriate boundaries with patients
  • You must properly document all patient interactions as required by law
  • You must have appropriate procedures for patient complaints and concerns

8. Platform Fees and Payments

Regarding compensation for services provided through the platform:

  • Healing Care charges a platform fee (commission) on consultations booked through the platform
  • Fees are deducted before payment is transferred to your account
  • You are responsible for setting your own consultation prices
  • Payments are processed according to the platform's payment schedule
  • You are responsible for all applicable taxes on your earnings
  • Disputed payments will be handled according to our Dispute Resolution process

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • HEALING CARE IS NOT LIABLE FOR ANY MEDICAL OUTCOMES, MALPRACTICE CLAIMS, OR PATIENT INJURIES
  • You agree to INDEMNIFY and HOLD HARMLESS Healing Care from any claims arising from your medical practice
  • Healing Care's total liability shall not exceed the fees paid to you through the platform in the past 12 months
  • Healing Care is not liable for platform downtime, technical issues, or data loss
  • You waive any claims against Healing Care related to your medical practice

You acknowledge that Healing Care is a technology platform only and does not practice medicine or provide healthcare services.

10. Indemnification

You agree to indemnify, defend, and hold harmless Healing Care SRL, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from:

  • Your medical practice, advice, diagnoses, or treatments
  • Any malpractice claims or professional liability suits
  • Your breach of these Practitioner Terms
  • Your violation of any patient's rights
  • Your failure to maintain required licenses or insurance
  • Any content you post on the platform
  • Your violation of any applicable laws or regulations

11. Term and Termination

Regarding the duration and termination of this agreement:

  • These terms remain in effect while you maintain an active practitioner account
  • You may terminate your account at any time through account settings
  • Healing Care may suspend or terminate your account immediately for violations
  • Termination does not release you from liability for prior actions
  • Sections on indemnification, limitation of liability, and dispute resolution survive termination
  • Upon termination, you must complete all pending patient consultations or arrange appropriate transfers

12. Dispute Resolution

Any disputes arising from these Practitioner Terms shall be resolved as follows:

  • First, attempt informal resolution by contacting legal@healing.care
  • If unresolved, disputes shall be submitted to binding arbitration in Bucharest, Romania
  • Class actions and class-wide arbitration are waived to the extent permitted by law
  • Claims must be brought within one (1) year of the event giving rise to the claim

13. Modifications to Terms

Healing Care reserves the right to modify these Practitioner Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the platform after changes constitutes acceptance.

BY REGISTERING AS A PRACTITIONER ON HEALING CARE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE PRACTITIONER TERMS OF SERVICE. YOU CONFIRM THAT YOU ARE A LICENSED HEALTHCARE PROFESSIONAL AND ACCEPT FULL RESPONSIBILITY FOR YOUR MEDICAL PRACTICE ON THIS PLATFORM.
