Terms of Service

To use certain features of Healing Care, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be at least 16 years old (or have parental consent)
• Have only one account per person
• Accept full responsibility for all activities under your account

Our platform may contain content posted by users, healthcare providers, and third parties. You acknowledge and agree that:

• We do NOT endorse, verify, or guarantee any user-generated or third-party content
• We are NOT responsible for the accuracy, completeness, or reliability of such content
• Healthcare providers are solely responsible for their own posts, answers, recommendations, and advice
• User reviews and ratings reflect personal opinions and may not be accurate
• We have no obligation to monitor, edit, or remove content but reserve the right to do so
• You rely on any content posted by others AT YOUR OWN RISK
• We are protected by safe harbor provisions for user-generated content

We act solely as a passive conduit for content posted by users and healthcare providers. We do not create, develop, or control such content.

When using Healing Care, you agree to:

• Provide accurate health information (false information may result in improper care)
• NOT use the platform for medical emergencies - call emergency services instead
• Verify the credentials and qualifications of any healthcare provider independently
• Make your own informed decisions about healthcare based on professional medical advice
• Not post content that is defamatory, harassing, obscene, or violates others' rights
• Not post false reviews, ratings, or misleading information
• Not impersonate others or misrepresent your qualifications
• Comply with all applicable laws and regulations

Healthcare providers on our platform independently agree to:

• Maintain valid medical licenses and credentials in their jurisdiction
• Provide accurate professional information and credentials
• Deliver care according to professional standards and applicable laws
• Maintain patient confidentiality in accordance with applicable regulations
• Not guarantee specific medical outcomes
• Maintain appropriate malpractice insurance
• Be solely responsible for all medical advice, diagnoses, and treatments provided

Healthcare providers acknowledge that Healing Care is not liable for their professional actions or omissions.

For paid services on Healing Care:

• Prices are displayed before booking confirmation
• Payments are processed securely through third-party payment processors (Stripe)
• We are not responsible for payment processor errors or issues
• Refunds are subject to our Refund Policy and provider policies
• Cancellations must be made at least 24 hours in advance
• No-shows may be charged the full consultation fee
• We do not guarantee insurance coverage or reimbursement

All content on Healing Care, including text, graphics, logos, and software, is owned by or licensed to Healing Care SRL. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks without authorization
• Remove any copyright or proprietary notices
• Use automated systems to access our platform without permission
• Scrape, data mine, or extract content from our platform

Your privacy is important to us. Our data practices are governed by our Privacy Policy. By using Healing Care:

• You consent to the collection and use of information as described in our Privacy Policy
• You acknowledge that no data transmission over the internet is 100% secure
• You are responsible for maintaining the confidentiality of your account
• We are not liable for unauthorized access resulting from your negligence

You agree to indemnify, defend, and hold harmless Healing Care SRL, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the platform or services
• Your violation of these Terms
• Your violation of any rights of third parties
• Any content you post or submit to the platform
• Your interactions with healthcare providers
• Any medical treatment or advice you receive through the platform
• Your negligence or willful misconduct

Any dispute arising from these Terms or your use of the platform shall be resolved as follows:

• First, you agree to attempt informal resolution by contacting us at legal@healing.care
• If informal resolution fails, disputes shall be submitted to binding arbitration
• Arbitration shall be conducted in Bucharest, Romania under Romanian arbitration rules
• Class action lawsuits and class-wide arbitration are waived to the extent permitted by law
• You waive any right to a jury trial
• Claims must be brought within one (1) year of the event giving rise to the claim

This arbitration agreement does not preclude you from filing complaints with regulatory authorities.

We may suspend or terminate your account immediately and without notice if:

• You violate these Terms of Service
• We are required to do so by law
• Your conduct harms other users or healthcare providers
• You provide false or misleading information
• We believe termination is necessary to protect the platform or users

Upon termination, your right to use the platform ceases immediately. Sections relating to limitation of liability, indemnification, and dispute resolution survive termination.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and any other legal notices published on the platform, constitute the entire agreement between you and Healing Care SRL regarding your use of the platform. Any prior agreements or understandings are superseded.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of Healing Care SRL.

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or through the platform. Your continued use of Healing Care after changes take effect constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the platform.

These Terms are governed by the laws of Romania and the European Union. Subject to the arbitration provisions above, any legal action shall be brought exclusively in the courts of Bucharest, Romania. You consent to personal jurisdiction in these courts.
